Welcome to Spill. These Terms of Service ("Terms") govern your access to and use of the Spill mobile application, website, and related services (collectively, the "Service"). The Service is operated by Clinton St, Inc.

By downloading, accessing, or using Spill, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

Users must be at least 13 years old. Those under 18 need parental or legal guardian consent. By using Spill, you represent that you have the legal capacity to enter this agreement.

Spill is an AI-powered journaling application enabling users to:

• Record voice or text journal entries
• Brain dump thoughts and ideas
• Receive AI-generated insights and summaries
• Identify patterns in thoughts over time
• Store and revisit past entries

The platform is designed for personal reflection and productivity. Spill is not a medical, psychological, or mental health service, and it is not a substitute for professional advice.

Certain features require account creation. Users must provide accurate information, maintain account security, and promptly notify the company of unauthorized access. Account holders are responsible for all activity under their account.

Some features of Spill require a paid subscription offered on monthly or yearly plans. Subscriptions automatically renew unless canceled before the renewal date. Payments are processed through the Apple App Store and Google Play. You must manage and cancel subscriptions through your original platform. Except where required by law, payments are non-refundable.

Free trials may be offered for certain subscriptions. If you begin a free trial without canceling before it ends, your subscription will automatically start and you will be charged. The company reserves the right to modify or terminate free trials at any time.

You retain ownership of all content you submit, including voice recordings, journal entries, text input, and generated reflections. By submitting content to the Service, you grant Clinton St, Inc. a limited license to store, process, analyze, and display your content solely for operating and improving the Service.

You agree not to submit content that is illegal, abusive, threatening, harmful, or infringing. The company reserves the right to remove content that violates these Terms.

Spill may generate summaries, insights, or recommendations using artificial intelligence. AI-generated outputs may be incomplete, may contain errors, and should not be treated as professional advice. Spill is not a therapy, medical, or counseling service. If you are experiencing mental health difficulties, please consult a licensed professional.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer or exploit the platform
• Interfere with the operation of the Service
• Upload malicious software or harmful code
• Abuse or harass other users

Violations may result in account suspension or termination.

All intellectual property related to the Service, including software, design, branding, trademarks, and content, is owned by Clinton St, Inc. or its licensors. Users receive a limited, non-exclusive, non-transferable license for personal use only.

The company may suspend or terminate your account if you violate these Terms, your use poses a risk to the platform, or the Service is discontinued. You may stop using Spill at any time.

To the maximum extent permitted by law, Clinton St, Inc. shall not be liable for indirect damages, loss of data, emotional outcomes related to app usage, or lost profits or business interruption. Your use of the Service is at your own risk.

The Service is provided "as is" and "as available" without warranties of any kind. The company does not guarantee that the Service will be uninterrupted, secure, error-free, or accurate.

The company may update these Terms at any time. Significant changes may trigger notifications through the application or website. Continued use of the Service after updates constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles.
